These Terms of Service govern your use of LumTale — our fair-AI portrait tools that keep your face faithfully yours. Please read them carefully. They explain what you may do with our service, what you may not do, and how ownership of your generated portraits works.
Last updated: January 1, 2026By accessing or using LumTale (the "Service"), you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you may not use the Service. We may offer certain features that have their own additional terms; in the event of a conflict, those additional terms govern the relevant feature, but these Terms continue to apply to the rest of the Service.
You represent that you have the legal capacity to enter into this agreement. If you are using the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" will refer to that entity.
The Service is intended for users who are at least 13 years of age. By using LumTale, you represent and warrant that you are 13 or older. If you are between 13 and the age of legal majority in your jurisdiction, you represent that you have your parent's or guardian's permission to use the Service. We do not knowingly provide the Service to children under 13, and if we learn that we have collected personal information from a child under 13, we will delete it as soon as reasonably possible.
LumTale is operated for and directed to users in the United States. The Service is provided and governed under United States law. If you access the Service from outside the United States, you are responsible for compliance with local laws, and you acknowledge that the Service may not be available or appropriate in your jurisdiction. We may restrict access in regions where the Service would violate applicable law.
LumTale provides fair, identity-preserving AI portrait generation under our original "Lumling" style. We built the Service around a single promise: your face stays your face — no whitening, no warping, no training on your photo. The Service is offered through two distinct doors, each with a different privacy model:
We may modify, suspend, or discontinue any part of the Service at any time, including adding or removing Lumling styles, adjusting quality, or changing which partner powers Door 2. We will try to give reasonable notice of material changes but are not obligated to do so for routine improvements.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for the content you upload and for the portraits you generate. You agree not to:
We reserve the right, but not the obligation, to review content and to refuse, remove, or block any upload or output that we believe violates these Terms or applicable law. These decisions are made in our discretion and do not create any duty on our part to monitor the Service.
You retain ownership of the portraits and other outputs generated from your own photo ("Your Outputs"). Subject to your compliance with these Terms, LumTale grants you a personal, worldwide, non-exclusive license to use, download, share, and display Your Outputs for personal and non-commercial purposes. Where the law permits you to hold intellectual property rights in AI-generated content, those rights belong to you, not to us.
LumTale retains all rights, title, and interest in and to the Lumling style, the Service's software, model weights, brand assets, design, and any improvements or derivatives of them. The Lumling name and look are original to LumTale and are not derived from any third-party artist or brand. Nothing in these Terms transfers ownership of the Lumling style or the Service to you, and you may not claim ownership of, register, or sell the Lumling style, name, or brand as your own.
Your Outputs are provided "as is", without warranty of any kind as to accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that any output will be unique, that it will match your expectations, or that it will be free from defects. You are responsible for confirming that your use of an output complies with applicable law and the rights of others.
Door 2 is powered by one or more independent third-party GPU processing partners ("Processing Partners") that perform the cloud render on our behalf. LumTale is not the operator of the Processing Partner's infrastructure. When you use Door 2, your photo is transmitted to the Processing Partner for the limited purpose of generating your Lumling portrait, and is handled according to the Processing Partner's own data-use policy, which we link before you upload.
We select and monitor our Processing Partners with care, but we make no representation or warranty regarding the Processing Partner's services, security, or conduct beyond what is stated in our Privacy Policy. To the fullest extent permitted by law, LumTale is not liable for any act, omission, or failure of any Processing Partner, including any loss, unauthorized access, or disclosure that occurs while your photo is in the Partner's environment. Your recourse for any such event is governed by the agreement between you and the Processing Partner as disclosed at upload time.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUMTALE, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE EVENT, OR (B) TWENTY-FIVE US DOLLARS ($25).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless LumTale and its affiliates, officers, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) any content you upload or any output you generate or share; or (d) your infringement of any third party's rights. We reserve the right to assume the exclusive defense of any matter for which you are required to indemnify us, and you agree to cooperate with that defense.
We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including if we believe you have violated these Terms, without prior notice and without liability to you. You may stop using the Service at any time. Upon termination, your right to use the Service ends immediately, and any license granted to you under these Terms ceases.
Sections of these Terms that by their nature should survive termination will survive, including ownership and license provisions, warranty disclaimers, limitation of liability, indemnification, governing law, and dispute-resolution clauses. Termination does not affect any rights or obligations that arose before termination.
If you believe that content available through the Service infringes your copyright, you may notify us by sending a written notice that includes: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material and enough information for us to locate it; (d) your contact information; (e) a good-faith statement that the use is not authorized; and (f) a statement, under penalty of perjury, that the notice is accurate. These Terms, and any dispute or claim arising out of or related to them or the Service, are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. If you are a consumer, nothing in this section deprives you of any mandatory consumer-protection rights you may have under the laws of your place of residence.
Except where prohibited by law, you agree that any dispute arising out of or relating to the Service or these Terms will be resolved through good-faith discussion first. If a dispute cannot be resolved informally, it will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Where permitted, and at LumTale's discretion, disputes may instead be resolved through binding arbitration on an individual basis; you and LumTale each waive any right to a class action or representative proceeding to the fullest extent allowed by law.
We may update these Terms from time to time to reflect changes in the Service, the law, or our practices. When we make material changes, we will revise the "Last updated" date at the top of this page and, where appropriate, provide additional notice (for example, through the Service or by email). Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Service.
